(Code regarding the Protection of Personal Data)

POLICY STATEMENT FOR THE DATA SUBJECT
(BUSINESS USERS)


Legislative Decree, 30 June 2003, n. 196, "Rules regarding the protection of personal data" ensures the protection of persons and other subjects regarding the processing of personal data by imposing a number of obligations on whoever processes information relating to other subjects. Among these obligations is the requirement to provide persons, to whom the data relates, with adequate information regarding the use of their data.
Pursuant to art.13 (note) of Legislative Decree, 30 June 2003, n.196, personal data, including sensitive data given to us or acquired in the course of the contractual relationship between us, may be the subject of data processing.

Processing
Legislative Decree 196/03 identifies the following steps in the processing of personal data:
collection, registration, organization, storage, consultation, processing, modification, selection, extraction, comparison, usage, interconnection, blocking, communication, dissemination, deletion and destruction.

Purposes of data processing
Personal data undergoing processing shall be utilized only for purposes connected to the fulfilment of the obligations arising from the law and the provisions of the contractual relationship held with you. In particular, it is needed to:
-        allow your staff access to Elettra - Sincrotrone Trieste S.C.p.A. in compliance with current safety standards in the laboratory
-        fulfil its obligations under Article. 26 of Legislative Decree 81/08
-        achieve effective management of contractual and pre -contractual relationships.

The nature of data delivery and the consequences of not providing it
With reference to personal data relating to you, we inform you that:
-        The conferment of data is compulsory in order to achieve the purposes related to legal and contractual obligations and therefore any refusal to supply it may result in the inability of our company to continue our contractual relationship
-        Missing data which is not directly attributable to legal and/or contractual reasons yet necessary for the carrying out of commercial relationships may, following a specific assessment of the writer, make it impossible to carry on  the contractual relationship in question in whole or in part.

Method of data processing
The handling and storage of your personal data will be subject to the rules of Legislative Decree n. 196/ 03 and in particular Title V, Chapter II, which dictates the minimum security measures, and may be performed by entities such as the owner, the manager/s (if nominated) and authorized personnel to carry out those tasks constantly identified, properly educated and made aware of the constraints imposed by Decree. 196/03.
Data processing can be carried out with the aid of electronic and computerised equipment, connected, or not, to the internet, or through the use of physical documents, according to rules strictly related to the purposes declared and, in any event, so as to ensure the safety, confidentiality and availability of data according to principles of correctness, lawfulness and transparency and the protection of privacy and your rights.
The data will be processed for the entire duration of the contractual relationship and even after the completion of all required legal formalities.

Communication and dissemination
Setting aside communications or data sent in pursuance of legal obligations, community legislation or contractual provisions, the disclosure of your personal data to third parties, managers or agents designated by the owner, may be required for:
-        the surveillance firm responsible for checking access to the site
our employees or consultants, including temporary staff.

In any case, the disclosure of personal information relating to you by any means is excluded without with your express prior consent.

Your rights
Pursuant to art. 7, Legislative Decree n. 196/03, the interested party has the right, at any time, to obtain confirmation of the existence, or not, of personal data concerning him or her, even if not yet recorded, and its communication in an intelligible form. You can therefore submit a request by letter to the data holder, who will provide immediate, appropriate response.

Legislative Decree, 30 June 2003, n. 196, establishes that the processing of personal data can only be done with the consent of the person concerned, except in cases of exclusion specifically designated by law. For this reason, please return the signed form which asks for your consent, as proof of having read the information referred to in this document, as well as an expression of consent to the processing of personal data.
