LEGISLATIVE DECREE n.196 of 30 June 2003

(Code regarding the Protection of Personal Data)



Legislative Decree No.196, 30 June 2003, governs the confidentiality of personal data and imposes a series of obligations on whoever processes information regarding other subjects. Among the obligations to be met:
  • inform the person to whom the information relates of the intended use ​​of their data
  • request consent to use their data for the reasons outlined
The law in question covers the following personal data processing: collection, modification, interconnection, registration, selection, blocking, organisation, extraction, cancellation, conservation, comparison, deletion, elaboration, usage.

Concerning the employment relationship existing on this day between you and Elettra – Sincrotrone Trieste S.C.p.A., and pursuant to art. 13 of Legislative Decree no. 196/03, we inform you that:
  • personal data relating to you and/or your family members that is requested, or that is received from you or from third parties in the course of employment, is required for:
    • the processing and payment of compensation and benefits
    • compliance with laws, contract and regulations in relation to:
      • social security institituions
      • financial admininistration
      • funding agencies
    • the fulfilments concerning the original activities for which the organisation was established
  • personal data will be managed:
    • by manual, computer, and telecommunication means
    • by individuals authorized in such tasks, constantly identifiable, properly trained, and made aware of the constraints imposed by Legislative Decree no. 196/ 03
    • with appropriate security measures meant to:
      • ensure the privacy of the individual whose data is being utilized
      • avoid improper access by unauthorised personnel and third parties
  • data, solely for reasons concerning the inherent nature of the work contract, will be communicated to:
    • social security, welfare and health bodies institutionally entrusted by the State
    • insurance companies selected for specific risk coverage
    • employment and tax consultants for payroll processing, for company tax obligations and specific purposes
    • banks and/or financial institutions for the payment of wages
    • occupational health physician or doctor in dealing with laws concerning safety procedures
    • consulting firms for training
    • business associations
    • food voucher suppliers
  • some of your personal data, including photographs and video footage may also be processed through publication on the laboratory website, in the Company "phonebook", or in promotional materials used for purposes relating to the disclosure of the company, its services and facilities.
Personal data:
  • is necessary for the continuation of the employment relationship
  • is almost always made ​​compulsory by law and therefore:
    • the refusal to provide such information
    • the failure to consent to the treatment of data indicated by the relevant clause of this communication, which make it necessary from time to time
would result in the inability to carry out procedures, even those in the employees interest including:
  • preparation of payroll
  • social security payments
  • tax payments
  • different operations concerning wage labour
Elettra – Sincrotrone Trieste S.C.p.A., in processing your personal data, may access sensitive data that may reveal:
  • a state of health through:
    • certificates relating to:
      • sick leave
      • maternity
      • accident
      • insurance procedures
    • data concerning fitness for specific work
    • goodwill obligations
    • data relating to requests for advances on severance pay
    • membership of a union through:
      • undertaking a union position
      • requesting a deduction for union membership payment
    • membership of a political party through:
      • requested authorisation or expectation of elective office duty
    • religious beliefs through:
      • requests to take part in religious holidays as foreseen by the law
  • Such information may only be processed:
    • with the written consent of the person concerned
    • through approval by the Guarantor for the protection of personal data
The handling of data by the Company requires the identification, pursuant to Legislative Decree no. 196/03, of a number of subjects who are governed by specific obligations and responsibilities. In particular:

We inform you that Article. 7 of Legislative Decree no. 196/03 gives you specific rights concerning this matter. In particular, you:
  • will be able to obtain from the data holder:
    • confirmation of the existence, or otherwise, of data concerning you and its communication in an intelligible form
    • knowledge of the origin of the data, the reason and purpose of its use
    • the identity of the data holder and its handlers
    • cancellation, transformation into anonymous form, or blocking of the data when processed in violation of the law
    • the updating, correction or, if there is interest, integration of data
  • you will also have the right to oppose, for legitimate reasons, the treatment of your data
We ask you to return the signed and dated statement attached, providing consent for the processing of your personal data, and in particular sensitive data referred to in art. 23 of Legislative Decree n. 196/03.
